Education-related Articles in the Proposed 2016 Charter of Thailand

One of the entries in the 2016 charter is the entry of education. Having looked into the proposed charter, I can sum it up as follows: As we know, education is seen and perceived as necessary for the well-being of the nation. The articles related to education and human resource development are seen as positive in nation development for sustainable future.

The first article is found in Section 6:

Section 6 Duties and Responsibilities of Thai Citizens
หมวด ๔ หน้าที่ของปวงชนชาวไทย

... (๔) เข้ารับการศึกษาอบรมในการศึกษาภาคบังคับ

(4) be educated and trained in the compulsory education

This stipulated that every Thai is required to attend a school until they complete the basic education level. In Thailand, at present (May 2016) the compulsory education is nine years.

So, it is required by law that every Thai child and youth attend schools in the compulsory-level education. This article is similar to the article in previous Charters.


Next is found in Article 56 under Section 5 on Duties and Responsibilities of the State

According to Article 54, the state is required to make every child and youth receive education for the period of 12 years, from the pre-school level until the end of the required (compulsory) level with quality without the child or youth having to pay for such the education.

Below is the Thai version of Article 58:

มาตรา ๕๔ รัฐต้องด าเนินการให้เด็กทุกคนได้รับการศึกษาเป็นเวลาสิบสองปี ตั้งแต่ก่อนวัยเรียนจนจบการศึกษาภาคบังคับอย่างมีคุณภาพโดยไม่เก็บค่าใช้จ่าย

Under the same article (54), the state must operate in ways that can make Thai children be taken care of and developed before they enter the education system in order to develop their physical bodies, minds, disciplines, emotions, social, and intellectual skills in ways that are suitable for their age.

Below is the Thai version of Article 54:

รัฐต้องด าเนินการให้เด็กเล็กได้รับการดูแลและพัฒนาก่อนเข้ารับการศึกษา ตามวรรคหนึ่ง เพื่อพัฒนาร่างกาย จิตใจ วินัย อารมณ์ สังคม และสติปัญญาให้สมกับวัย

To continue:

It is also stipulated that the Thai State shall promote and support local administrative governments and private organizations to participate and take part in education administration and provision.

โดยส่งเสริม และสนับสนุนให้องค์กรปกครองส่วนท้องถิ่นและภาคเอกชนเข้ามีส่วนร่วมในการด าเนินการด้วย

The State must operate to make the citizens receive education as required in the systems, including the operation of the state to promote life-long learning and the operation to make the cooperation and collaboration among the State agencies, the Private Organizations, and the Local Governments to manage and provide quality education in ALL Levels, under the condition that The State has the duty to operate, monitor, promote, support such the cooperation to ensure quality education and meet the international standards.

รัฐต้องดำเนินการให้ประชาชนได้รับการศึกษาตามความต้องการในระบบต่าง ๆ รวมทั้งส่งเสริมให้มีการเรียนรู้ตลอดชีวิต และจัดให้มีการร่วมมือกันระหว่างรัฐ องค์กรปกครอง ส่วนท้องถิ่น และภาคเอกชนในการจัดการศึกษาทุกระดับ โดยรัฐมีหน้าที่ด าเนินการ กำกับ ส่งเสริม และสนับสนุนให้การจัดการศึกษาดังกล่าวมีคุณภาพและได้มาตรฐานสากล

That is to be done in accordance with the law and articles in the National Education, which is stated that at least the National Education Plan and the mechanisms and systems to monitor and ensure that the educational affairs are proceeded in accordance with the plan. Education in all levels must develop the students to be 'good citizens' with discipline, proud in being Thais, and they have the skills and abilities based on their interests and aptitudes, responsible to their families, communities, society, and the nation.

ทั้งนี้ ตามกฎหมาย ว่าด้วยการศึกษาแห่งชาติซึ่งอย่างน้อยต้องมีบทบัญญัติเกี่ยวกับการจัดท าแผนการศึกษาแห่งชาติ และการด าเนินการและตรวจสอบการด าเนินการให้เป็นไปตามแผนการศึกษาแห่งชาติด้วย การศึกษาทั้งปวงต้องมุ่งพัฒนาผู้เรียนให้เป็นคนดี มีวินัย ภูมิใจในชาติ สามารถเชี่ยวชาญได้ตามความถนัดของตน และมีความรับผิดชอบต่อครอบครัว ชุมชน สังคม และประเทศชาติ

This bit is interesting and worth noting:

In the operation to make children be taken care of and developed in Paragraph 2 or to make the citizens (youths and adults) in Article 3, the State must operate to make sure that those lacking money / capitals be financially supported to receive the education based on their aptitudes.

ในการดำเนินการให้เด็กเล็กได้รับการดูแลและพัฒนาตามวรรคสอง หรือให้ประชาชนได้รับการศึกษาตามวรรคสาม รัฐต้องดำเนินการให้ผู้ขาดแคลนทุนทรัพย์ได้รับ การสนับสนุนค่าใช้จ่ายในการศึกษาตามความถนัดของตน

The State shall set up the Education Fund to help those students lacking financial means, to reduce the gap in education, and to promote and develop the quality and effectiveness of the teachers. The State is required to allocate  the budget to financially support the FUND Or to use the taxation mechanisms, including the mechanisms to get some funds from the donation by granting taxation privileges to those who donate to the fund, based on the law. Such the law, at the minimum, must at least stipulate that the administration of the FUND be independent and requires that the management of finance and budget be made to achieve such the goals.  
 
 ให้จัดตั้งกองทุนเพื่อใช้ในการช่วยเหลือผู้ขาดแคลนทุนทรัพย์เพื่อลดความเหลื่อมล้ำ ในการศึกษา และเพื่อเสริมสร้างและพัฒนาคุณภาพและประสิทธิภาพครู โดยให้รัฐจัดสรรงบประมาณ ให้แก่กองทุน หรือใช้มาตรการหรือกลไกทางภาษีรวมทั้งการให้ผู้บริจาคทรัพย์สินเข้ากองทุน ได้รับประโยชน์ในการลดหย่อนภาษีด้วย ทั้งนี้ ตามที่กฎหมายบัญญัติ ซึ่งกฎหมายดังกล่าว อย่างน้อยต้องกำหนดให้การบริหารจัดการกองทุนเป็นอิสระและกำหนดให้มีการใช้จ่ายเงินกองทุน เพื่อบรรลุวัตถุประสงค์ดังกล่าว


Article 69 on research and development

"The State shall provide and support research and development in sciences, technologies, and knowledge in other fields, in order to create knowledge, development, and innovation, for the strength of the Thai society and the building of Thai people's abilities."

มาตรา ๖๙ รัฐพึงจัดให้มีและส่งเสริมการวิจัยและพัฒนาวิทยาศาสตร์ เทคโนโลยี และศิลปวิทยาการแขนงต่าง ๆ ให้เกิดความรู้ การพัฒนา และนวัตกรรม เพื่อความเข้มแข็งของสังคม และเสริมสร้างความสามารถของคนในชาต

We are pleased to read this article (69).



Article 250 under the section: Local Administration

มาตรา ๒๕๐ องค์กรปกครองส่วนท้องถิ่นมีหน้าที่และอ านาจดูแลและจัดท า
บริการสาธารณะและกิจกรรมสาธารณะเพื่อประโยชน์ของประชาชนในท้องถิ่นตามหลักการพัฒนา
อย่างยั่งยืน รวมทั้งส่งเสริมและสนับสนุนการจัดการศึกษาให้แก่ประชาชนในท้องถิ่น ทั้งนี้ ตามที่
กฎหมายบัญญัติ

The 2016 Proposed Charter has many aims and one of which is to revamp the country in many fronts - one reform effort is in education.

Under Section 16 on the Reformation of Thailand, there are clauses and sentences dealing with education, too. let's have a close look.

หมวด ๑๖ การปฏิรูปประเทศ

จ. ด้านการศึกษา
E. Educational Reform

1) The reform shall make realize what is stipulated in Article 54 mentioned earlier: to ensure that Thai children be looked after and nurtured before they enter the education system, This is to make the childern be developed physically, mentally, socially emotionally, intellectually, with well-disciplined behavior, suitable for their age group, without having to pay for the education.

 (๑) ให้สามารถเริ่มดำเนินการให้เด็กเล็กได้รับการดูแลและพัฒนาก่อนเข้ารับการศึกษาตามมาตรา ๕๔ วรรคสอง เพื่อให้เด็กเล็กได้รับการพัฒนาร่างกาย จิตใจ วินัย อารมณ์สังคม และสติปัญญาให้สมกับวัยโดยไม่เก็บค่าใช้จ่าย

2) To enact the law to set up the found according to Article 54 (paragraph 6) within 1 year after the Charter has its effective right. 

 (๒) ให้ด าเนินการตรากฎหมายเพื่อจัดตั้งกองทุนตามมาตรา ๕๔ วรรคหก ให้แล้วเสร็จภายในหนึ่งปีนับแต่วันประกาศใช้รัฐธรรมนูญนี้

3) To set up the mechanisms and systems to select, recruit, and develop 'professional teachers' and 'university lecturers' so that they have 'the Kuru Spirit' and Real competencies of the teaching profession, and to ensure that they receive remunerations in accordance with their abilities, as well as the system to ensure ethical standards in personnel management of the teaching profession.

 (๓) ให้มีกลไกและระบบการผลิต คัดกรองและพัฒนาผู้ประกอบวิชาชีพครู และอาจารย์ให้ได้ผู้มีจิตวิญญาณของความเป็นครูมีความรู้ความสามารถอย่างแท้จริง ได้รับค่าตอบแทนที่เหมาะสมกับความสามารถและประสิทธิภาพในการสอน รวมทั้งมีกลไกสร้างระบบคุณธรรมในการบริหารงานบุคคลของผู้ประกอบวิชาชีพครู

4) To improve and provide instruction in all levels to help learners learn according to their aptitudes and improve the structure of the organizations, both direct and related organizations, to realize such the aims, and be in harmonious fashion in all levels across the kingdom.

 (๔) ปรับปรุงการจัดการเรียนการสอนทุกระดับเพื่อให้ผู้เรียนสามารถเรียนได้ ตามความถนัด และปรับปรุงโครงสร้างของหน่วยงานที่เกี่ยวข้องเพื่อบรรลุเป้าหมายดังกล่าว โดยสอดคล้องกันทั้งในระดับชาติและระดับพื้นที่
